Agreement

The following contract is based on a studio session. Prices vary depending on requirements of client and type of photo shoot. All requirements are to be discussed and agreed prior to shoot with Photographer in order to attain an accurate quote.

1. Scope of Work 

This contract is for services and products related to a photography shoot (hereafter “shoot” or “the shoot”) to take place at the following time and place. 

Photographer and Client are to arrive for the shoot at ____________(time) at _________________________(place).

If shoot extends beyond allotted time slot of ________, an additional fee of £30 (thirty) per 30 (thirty) minutes will be due at the end of the session. Photographer agrees to provide no fewer than 15 images for Client to view after the shoot, and is not required to provide more than this number of images. Photographer will perform post-processing or digital image editing services on these images where necessary.

 

2. Fees 

For the photography services provided by Photographer, Client must pay 50% (fifty percent) via PayPal upon booking a studio session, totalling at ________. The outstanding amount of ________ is to be paid in full upon signing this contract. The initial payment reserves the Photographer’s time and is not a retainer or deposit. If Client cancels this shoot for any reason, the initial payment will not be returned to Client. This shoot can be rearranged for another time slot no more than twice after the initial booking. Photographer retains the right to deny service beyond a second rescheduling and the initial payment will not be returned to Client.
 

Client is required to purchase a minimum of 3 (three) images from the studio session. These will be viewable during a later session with Photographer. Every digital copy of the images given to the Client will be digitally enhanced to a high standard. These finished images will be £10.00 each. This fee must be paid in full during the follow up session, either by cash or PayPal.

Past 60 (sixty) days after the shoot, if Client would like Photographer to retain images from the shoot, an additional archiving fee of £20.00 can be made at any point during or up to the end of the 60 (sixty) days. This will ensure the previously viewed images will remain on file for a further 60 (sixty) days.
 

3. Work Product 

Photographer will organise a follow up session with Client no more than thirty days (30 days) after the date of the shoot. Client understands and agrees that the images are the exclusive property of Photographer and Client has no right to these images except for a license to review them, but not to retain copies without payment. 
 

All images delivered to Client are licensed for Client’s personal use only. No “RAW” or unedited images will be made available to Client. Client will receive their selected images as high-resolution, digitally enhanced digital copies, which will be made available to download at their convenience. Under no circumstance is Client permitted to edit or affect images once received from Photographer. Legal action will be taken to remove these from public forum. Furthermore, Client is not permitted to profit from imagery created during sessions, and will need written consent from Photographer to use images for competition.
 

4. Indemnification 

4.1 - Photographer and Client agree that Photographer is under no obligation to capture any specific moment or pose or person(s) during the shoot. 
 

4.2 - If Photographer is unable to perform the services in this contract due to any cause outside of its control, client agrees to indemnify Photographer for any loss, damage or liability; however, in these circumstances, Client will be reimbursed for the value of the session only. 
 

4.3 - Client agrees to indemnify and hold harmless Photographer for any liability, damage, or loss related to technological failure, including data loss. 
 

4.4 - Client understands and agrees that Photographer is not required to retain copies of the images more than 60 (sixty) days after the shoot, unless archiving arrangement has been made. 
 

4.5 - Client agrees to hold Photographer harmless for any personal injury which may occur during the session or within the premises of the studio. 
 

4.6 - Photographer will strive to present photos in a workmanlike manner but is not required to cater to specific aesthetic preferences of Client. 
 

5. Model Release 

Client grants permission to Photographer and its assigns, licensees, and sublicensees, permission to use Client’s image or likeness in any and all forms of media for commercial purposes, advertising, trade, personal use, or any and all other uses. Therefore, Photographer may use Client’s likeness and image on Photographer’s website or other advertising. 

To be exempt from this clause, Client must notify Photographer ahead of shooting, as an additional fee of £35 (thirty-five) will be charged. This additional fee must be paid in full at the beginning of the session, either by cash or PayPal.


6. Assignability and Parties of Interest 
Client agrees and understands that, unless otherwise specified in this Contract, Client is not contracting for a personal service that will be performed by any specific Photographer. Photographer may sub-contract or assign this contract to any second-shooter; Photographer may assign any Photographers associated with the Photography Company to perform its duties under this contract. All Photographers must be capable and competent to perform the services in a workmanlike manner.
